Visum für ein Praktikum für Südafrika

Die Ausländerbehörde stoppte 2012 quasi alle Erteilungen von 11 (2) Permits für Praktika in Südafrika. Von nun an, müssen jene, welche nur für kurze Zeit hier in Südafrika arbeiten wollen, zunächst eine normale Arbeitsgenehmigung mit einer langen Liste von Dokumenten beantragen.

Südafrikanische Botschaft zum Praktikum in Südafrika

Seit dem Bericht Der Fall „Mavericks“ - Neuste Entwicklung, die besonders auch Praktika in Südafrika betreffen haben sich die Unsicherheiten beim Visum für ein Praktikum in Südafrika noch lange nicht geklärt. Daher kommentarlos hier die originalen Schreiben vom Südafrikanischen Konsulat in Berlin zum "Freiwilliges Praktikum", "Unbezahltes Pflichtpraktikum" und Bezahlte Praktika.

Freiwilliges Praktikum

Wir beziehen uns auf Ihre Anfrage und bestätigen, dass die südafrikanische Gesetzgebung bzw. das ‚Immigration Act, as amended’ keine Aufenthaltsgenehmigung/Erlaubnis für die Absolvierung eines ‘freiwilligen’ Praktikums ohne Vergütung bei einer südafrikanischen Firma oder Institution vorsieht. Bitte beachten Sie dass ein Praktikum (internship) vom südafrikanischen Innenministerium (Department of Home Affairs) als Gelegenheitsbeschäftigung (casual employment) betrachtet wird. Einem ausländischen Staatsbürger, der beabsichtigt in der Republik Südafrika zu arbeiten, ungeachtet ob mit oder ohne Bezahlung/Vergütung, muss eine Arbeitserlaubnis ausgestellt werden.

Im Falle einer kurzzeitigen oder dringenden Beschäftigung (nicht länger als 90 Tage), die von der Beantragung einer Arbeitserlaubnis nicht erfüllt werden kann, kann einem ausländischen Staatsbürger einmalig eine Erlaubnis mit einer Besuchergenehmigung zu arbeiten wie in § 11(2) des Einwanderungsgesetzes (Immigration Act, as amended) ausgestellt werden (s. Anhang) – bitte beachten Sie, dass diese Erlaubnis bei der Einreise in die Republik Südafrika beantragt bzw. von einem Grenzbeamten ausgestellt wird.

Aufgrund der Tatsache, dass die Erteilung der Erlaubnis mit einer Besuchergenehmigung zu arbeiten in letzter Zeit von den Grenzbeamten strenger geregelt wird, muss der südafrikanische Arbeitgeber/Partner die Verantwortung für den ausländischen Mitarbeiter übernehmen, d.h. nach Absprache mit dem südafrikanischen Innenministerium vor Ort muss der südafrikanische Arbeitgeber im Voraus bestätigen, ob die Erlaubnis mit einer Besuchergenehmigung zu arbeiten in Frage käme oder eine Arbeitserlaubnis im Heimatland unbedingt beantragt werden muss.

Unbezahltes Pflichtpraktikum

In the case of a prescribed internship (Pflichtpraktikum) for a period exceeding ninety (90) days, a study permit may be issued under special conditions to a foreign student, who wishes to conduct an internship at a South African company / institution. In both the application for authorisation to work on a visitor's permit or application for a study permit, the following documentation is required to confirm the purpose and duration of the visit:

• A letter from the applicant's higher educational institution abroad in English (or accompanied by a sworn English translation) confirming that the applicant is a student and for his or her course of studies an internship prescribed i.e. work experience forms part of studies;
• A letter from the South African higher educational institution confirming that an agreement/programme exists between the South African higher educational institution and the applicant's higher educational institution abroad and providing the contact details of the academic / person taking responsibility for the student intern and a fixed address of the student intern;
• A letter from the South African company / institution confirming the duration of the internship, its relationship to the agreement/programme of the education institutions and the work-related activities to be conducted by the student intern;
• A declaration from the applicant in English that he or she will not engage in any form of remunerated or non-remunerated work other than that covered in the letter from the company / institution.

Please note that the Immigration Act, as amended, does not make any provision for an 'unpaid internship', which is not prescribed i.e. required as part of a foreigner's studies.

Bezahltes Praktikum

We refer to your enquiry and hereby confirm that a foreigner, who is under twenty-five (25) years of age and who has received an offer to conduct work in the Republic of South Africa (e.g. aupairs, GAP students, interns, etc.) for no longer than one (1) year, may be issued with an exchange work permit. In the offer of employment, the prospective employer in the Republic of South Africa must certify that the position exists, and commit himself or herself to:

1. pay the applicant remuneration which complies with applicable legal requirements;
2. provide for the welfare and the needs of the applicant while in the Republic of South Africa under the exchange permit; and
3. report to the Department of Home Affairs the failure of the applicant to comply with the terms of his or her permit, or to depart when so required;

Please note that Part P of the form BI-1738 does not have to be completed by the prospective employer in the Republic of South Africa for an application for an exchange work permit.
